Your agreement with us
These Terms of Service (“Terms”) are a binding agreement between you and SimplyTenders. They apply when you access or use simplytenders.co.za, a SimplyTenders account, tender alerts, supplier-workspace tools or related services (together, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy.
You must be at least 18 and legally capable of entering into this agreement. If you use the Service for a company or other organisation, you confirm that you have authority to bind it, and “you” includes that organisation.
What SimplyTenders provides
The Service helps users discover tender notices, filter and review opportunities, receive alerts, organise supplier-readiness information, track submission work and request assistance with tender-related insurance. Features may differ by account, device or availability.
SimplyTenders is not a tender issuer, bid adjudicator or government body. Using the Service does not register you as a supplier, submit a bid, guarantee eligibility, reserve an opportunity, or improve the likelihood of an award.
Tender information and deadlines
We obtain tender information from public procurement sources and information supplied by buyers or other third parties. We work to present it clearly, but notices may be incomplete, delayed, amended, cancelled, duplicated or inaccurate.
The official tender notice and documents issued by the relevant buyer always take precedence over information shown by SimplyTenders. You are responsible for verifying the opportunity, eligibility rules, compulsory briefings, specifications, submission method and closing time directly with the issuing organisation. Do not rely on an alert, countdown or summary as your only deadline control.
Accounts and security
You must provide accurate, current information, keep it updated, protect your password and devices, and promptly tell us if you suspect unauthorised access. You are responsible for activity under your account unless applicable law provides otherwise. Accounts may not be sold, transferred or shared in a way that compromises security.
We may send service-related messages necessary to verify, secure or administer an account. Tender alerts can be changed or disabled in your alert settings.
Acceptable use
You may use the Service only lawfully and for legitimate procurement or business purposes. You must not:
- misrepresent your identity, authority, qualifications or bid status;
- submit unlawful, malicious, infringing or misleading content;
- attempt to bypass access controls, probe vulnerabilities, introduce malware, disrupt the Service or access another user’s information;
- scrape, copy or use automated means at a volume that degrades the Service or violates a source’s rights or terms;
- reverse engineer or resell a material part of the Service except where the law expressly permits it; or
- use the Service for fraud, collusion, corruption, bid-rigging or any other prohibited procurement conduct.
Your information and documents
You retain ownership of information and documents you provide. You give us a limited permission to host, copy, process and transmit submitted content only as reasonably needed to operate the Service, fulfil your request, protect the platform and comply with law.
You confirm that you have the rights and authority needed to provide that content and that it does not unlawfully disclose confidential or personal information. Readiness-vault files are currently stored in your browser. You are responsible for backups and for securing the device; clearing browser data may permanently remove them.
Insurance enquiries
Insurance pages, recommendations and forms provide general information and a way to request assistance. They are not financial advice, an insurance contract, a binder of cover, or a guarantee that cover will be offered. Any quotation or policy is subject to the provider’s assessment, terms, exclusions, limits, pricing and underwriting approval.
You authorise us to use the information submitted with an enquiry and, where needed, pass it to an insurance provider, broker or authorised representative so they can respond. You should review that provider’s advice, disclosures, quotation and policy wording before making a decision.
Third-party services
The Service may link to government portals, tender issuers, insurers and other third-party websites or use third-party technology providers. Their services, content, availability, security and privacy practices are controlled by them, not us. A link or integration does not imply endorsement, and your use of a third-party service is subject to its own terms.
Intellectual property
The SimplyTenders name, logo, interface, software, original text, arrangement and other platform materials belong to us or our licensors and are protected by applicable intellectual-property law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose.
Public tender documents and third-party names, marks and content remain the property of their respective owners. You may link to public SimplyTenders pages, provided the link is lawful and does not imply an affiliation or endorsement that does not exist.
Changes and availability
We may improve, add, remove or limit features and may perform maintenance. We do not promise that the Service, a particular tender source or an alert will always be available, uninterrupted or error-free. Where reasonably practicable, we will give notice of a material change that adversely affects active users.
Disclaimers and liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties that tender information is complete, current or suitable for your business. You remain responsible for procurement, commercial, legal, tax, compliance and insurance decisions and should obtain professional advice where appropriate.
To the fullest extent permitted by law, SimplyTenders will not be liable for indirect, incidental, special or consequential loss, loss of profit or opportunity, unsuccessful bids, missed deadlines, or loss caused by third-party content or services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or any rights you may have under mandatory consumer law.
Suspension and termination
You may stop using the Service at any time and may ask us to close your account. We may suspend or terminate access where you materially breach these Terms, create security or legal risk, misuse the Service, or where we discontinue the Service. Where appropriate, we will give notice and an opportunity to remedy the issue.
Provisions that by their nature should continue after termination—including ownership, disclaimers, liability and dispute provisions—will continue to apply.
Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Before starting formal proceedings, you and SimplyTenders agree to try in good faith to resolve a dispute by written notice and reasonable discussion. If it is not resolved, South African courts with jurisdiction may hear the dispute.
If any provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the agreement about your use of the Service unless separate written terms expressly apply.
Changes and contact
We may update these Terms to reflect changes to the Service, law or risk. We will publish the revised Terms here and update the date above. If a material change affects registered users, we will provide additional notice where reasonably practicable. Continued use after the effective date means the updated Terms apply.
